Conditions of Use

1. General

All orders are subject to these terms and conditions, which take precedence over any others. Your use of this site indicates your express acceptance and agreement to comply with all the terms and conditions outlined in this statement. If you do not accept and agree to these terms and conditions, please refrain from using this site. It is possible that we may modify these terms and conditions without prior notice.

2. Prices

The prices stated are in £ Sterling and do not include VAT and Carriage charges. Birkdale Studios determines the optimal production method for your order decoration, and the prices are based on that selection.

3. Terms of Payment

Unless alternative credit terms have been agreed, payment for orders must be made via credit/debit card. Birkdale Studios does not consider orders to be binding until they have been accepted. Birkdale Studios reserves the right to invoice different parts of an order separately. We also reserve the right to cancel an order at any stage of the process, without prior notification and without incurring liability.

4. Changing Orders

As we begin processing orders right after confirmation, we consider all submitted orders to be final. Although we will attempt to accommodate any requests to modify or cancel an order, we cannot guarantee our ability to fulfil them.

5. Delivery

The delivery times provided are estimates and should not be considered as guarantees. We do not accept any liability for any losses resulting from delays or errors in the delivery of goods. Deliveries outside of the UK may be subject to various restrictions, including customs, legal, regulatory, and practical limitations. To comply with local laws, you or the recipient may be obligated to pay additional taxes, fees, or levies. Birkdale Studios reserves the right to divide an order into multiple deliveries, with different timeframes, without incurring liability.

6. Returns Policy

Because we produce personalised goods, we are unable to accept returns except in cases where we have made an error, or the garments are defective. It is important to note that the Distance Selling Regulations Act of 2000 does not apply to "personalised goods or goods made to a consumer's specification.

7. Carriage

Unless stated otherwise, an additional charge will be applied for carriage costs. The price includes standard packaging, but if the buyer requests special packaging, an additional cost will be incurred.

8. Passing of Property and Risk

Title to products passes from Birkdale Studios to you on shipment from our facility.

9. Claims

9.1 If you experience damages, delays, or partial loss of goods during transit, any claims must be made in writing and sent to us within 3 days of delivery.

9.2 Any claims regarding the quality or quantity of goods must be submitted in writing and received by us within 3 days of receiving the goods. Failure to do so will result in the goods being considered compliant with the terms of the contract, in terms of quality and quantity.

9.3 Claims related to non-delivery must be communicated to us within 3 days of receiving our invoice.

10. Liability

To the maximum extent permitted by law, Birkdale Studios and its affiliates, partners, employees, or other representatives shall not be held liable for any damages resulting from the use of this website, or any information, content, materials, or products included on this site. This is an all-encompassing liability limitation that applies to all types of damages, including (but not limited to) compensatory, direct, indirect, or consequential damages, loss of data, income or profit, loss of or damage to property, and claims made by third parties.

11. Indemnity

The buyer is responsible for indemnifying Birkdale Studios against any claims related to the infringement or alleged infringement of third-party patent, copyright, or other intellectual property rights, as well as all costs and expenses incurred in connection with such claims, resulting from the implementation of the buyer's designs, patterns, or specifications.

12. Notices

If notice is given by post or email to the recipient at their principal or registered office, it will be considered properly served when it reaches its destination in the ordinary course of post or transmission.

13. Complaints Procedure

14. Force Majeure

We shall not be held liable for the failure or delay in fulfilling our obligations under the contract due to causes beyond our reasonable control, or inability to acquire materials or articles except at higher prices due to any such cause. In such circumstances, we reserve the right to terminate the contract in whole or in part, without incurring any liability to you, by providing notice.

15. Governing Law

The interpretation and construction of these terms and conditions shall be in accordance with the laws of England and Wales. The English Courts shall have non-exclusive jurisdiction over any disputes arising from these terms and conditions.
